FERC Seeks Greater Consistency In ATC Calculations
FERC issued a notice of proposed rulemaking (NOPR) that proposes to amend regulations adopted in Order Nos. 888, 889, and the pro forma open access transmission tariff (OATT), to ensure that transmission services are provided on a basis that is just, reasonable, and not unduly discriminatory or preferential. The NOPR proposes to improve transparency and consistency in several areas, including the calculation of available transfer capability (ATC).
FERC proposes to make certain elements of ATC more consistent, and directs public utilities, under the auspices of NERC and the North American Energy Standards Board, to provide for greater consistency and transparency in ATC calculations. FERC is concerned that the absence of a consistent methodology to determine ATC provides discretion to transmission providers to deny service to competitors. The NOPR also proposes to increase the transparency of ATC calculations through additional pro forma OATT requirements and postings on the open-access same-time information systems (OASIS) required under Order No. 889. Comments on the NOPR are due 60 days after publication in the Federal Register.
